Definitions
Throughout this document, the term “AstroGiagraphy” refers collectively to the brand AstroGiagraphy, the limited liability company GiagraphyByGianna LLC, its owner Gianna Succi, and any and all affiliated entities, subsidiaries, successors, assigns, employees, contractors, and representatives operating under or on behalf of any of the above. Any rights, protections, limitations of liability, or legal provisions granted to “AstroGiagraphy” in these terms shall extend equally and fully to all parties included in this definition.
1. General Disclaimer
The astrological services, reports, consultations, courses, and content provided by AstroGiagraphy, operated by GiagraphyByGianna LLC (Gianna Succi) are intended for educational, informational, and entertainment purposes only. Astrology is not a substitute for professional medical, psychological, legal, or financial advice. Clients and customers are encouraged to exercise their own judgment and to consult licensed professionals for matters related to health, mental health, legal concerns, or financial planning.
2. Nature of Services
Astrology is a symbolic and interpretive practice. No astrological reading, report, or consultation should be interpreted as a guarantee of specific outcomes, a prediction of future events, or a directive for making major life decisions. All interpretations are based on astrological symbolism and the practitioner’s professional analysis, and are offered as one lens of understanding among many. Results, insights, and personal resonance with the material will vary from person to person. Subjective satisfaction with an astrological interpretation is not grounds for a claim of defective or inadequate service.
3. Scope of Services
AstroGiagraphy’s services are limited exclusively to astrological interpretation, education, and consultation. Gianna Succi is not a licensed therapist, counselor, psychologist, psychiatrist, medical professional, financial advisor, attorney, or any other licensed practitioner. Nothing provided through AstroGiagraphy’s services should be construed as professional advice in any licensed field. The client acknowledges that AstroGiagraphy does not operate under the standards of care, ethical codes, or regulatory requirements applicable to any licensed profession, and that no professional-client relationship outside of astrological consultation is created by engaging with these services.
4. No Guarantee of Satisfaction
AstroGiagraphy does not guarantee personal satisfaction with any reading, report, consultation, course, or digital product. Due to the inherently subjective and interpretive nature of astrological services, individual experiences and levels of resonance with the material will vary. A client’s personal dissatisfaction with the content, tone, or conclusions of an astrological interpretation does not constitute grounds for a refund, chargeback, formal complaint, or legal claim. By engaging with any service, the client acknowledges and accepts this inherent variability.
5. Voluntary Engagement Acknowledgment
By purchasing or engaging with any AstroGiagraphy service, product, or content, the client confirms that they are doing so of their own free will and volition. The client acknowledges that they were not coerced, pressured, or misled into making any purchase or booking, and that they had adequate opportunity to review all relevant terms, service descriptions, and pricing before engaging. The client further acknowledges that they understand the nature and scope of astrological services as described in these terms.
6. Assumption of Risk and Informed Consent
By purchasing or engaging with any services, products, or content, you acknowledge that you are voluntarily seeking astrological guidance and that you understand the inherently interpretive nature of this work. You accept full responsibility for how you choose to apply or act upon any information received. You further acknowledge that differences in personal expectation, interpretation, or satisfaction do not constitute a failure of service on the part of the practitioner.
7. Refund and Dispute Policy
All sales of digital products, written reports, course materials, and pre-recorded content are final and non-refundable. Live consultations and readings are non-refundable once the session has been delivered or the scheduled session time has passed. If a client fails to attend a scheduled session without providing at least 48 hours’ notice, the session will be considered delivered and no refund or reschedule will be offered.
In the event of a dispute, the client agrees to contact AstroGiagraphy directly to attempt resolution in good faith before pursuing any external action. Any unresolved disputes shall be governed by the laws of the Commonwealth of Pennsylvania, and both parties agree to resolve such disputes through mediation or binding arbitration in Bucks County, Pennsylvania, rather than through litigation. The client agrees to waive any right to participate in a class action lawsuit or class-wide arbitration related to these services.
8. Chargeback and Payment Dispute Policy
Clients agree to contact AstroGiagraphy directly to resolve any billing concerns before initiating a chargeback or payment dispute with their bank or credit card company. If a client initiates a chargeback or payment dispute without first attempting to resolve the matter directly with AstroGiagraphy, the client shall be responsible for the original charge, all chargeback fees assessed by payment processors, and an administrative fee of $50.00 to cover the cost of responding to and resolving the dispute. AstroGiagraphy reserves the right to pursue recovery of all amounts owed through collections, small claims court, or any other legal means available under the laws of the Commonwealth of Pennsylvania. A chargeback initiated without prior good-faith communication with AstroGiagraphy may be treated as a fraudulent dispute.
9. Subscription and Recurring Billing Terms
For any subscription-based services, memberships, or recurring billing arrangements offered through AstroGiagraphy or third-party platforms such as Patreon, the client is solely responsible for managing their subscription and canceling before the next billing cycle if they no longer wish to be charged. AstroGiagraphy is not responsible for issuing refunds for charges resulting from a client’s failure to cancel their subscription prior to renewal. Subscription fees are non-refundable once processed, regardless of whether the client accessed or consumed the content during that billing period. If a subscription is managed through a third-party platform, the client must follow that platform’s cancellation procedures, and AstroGiagraphy bears no responsibility for charges incurred due to the client’s failure to do so.
10. Limitation of Liability
Under no circumstances shall AstroGiagraphy or its owner be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of or reliance upon any astrological services, content, or products provided. The maximum liability of AstroGiagraphy in connection with any service shall not exceed the amount paid by the client for that specific service.
11. Indemnification
The client agrees to indemnify, defend, and hold harmless AstroGiagraphy, its owner, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to the client’s use of services, violation of these terms, or any action taken based on information received through AstroGiagraphy’s services. This includes, but is not limited to, claims arising from defamatory statements, fraudulent chargebacks, frivolous legal actions, or the misrepresentation of services received.
12. Attorney’s Fees and Legal Costs
In the event that any legal action, arbitration, or formal proceeding is brought by the client against AstroGiagraphy in connection with services provided under these terms, and AstroGiagraphy is found to be the prevailing party, the client shall be responsible for all reasonable attorney’s fees, court costs, arbitration fees, and related legal expenses incurred by AstroGiagraphy in defending against the claim. This provision is intended to deter frivolous, bad-faith, or retaliatory legal actions and applies to all disputes arising from or related to these terms.
13. Right to Refuse or Terminate Service
AstroGiagraphy reserves the right, at its sole and absolute discretion, to refuse service to, cancel bookings for, or terminate the client relationship with any individual at any time and for any reason, including but not limited to abusive or threatening behavior, violation of these terms, fraudulent activity, or any conduct that AstroGiagraphy deems disruptive or incompatible with the professional delivery of services. In the event of termination initiated by AstroGiagraphy, a refund may be issued at AstroGiagraphy’s sole discretion. No refund is guaranteed upon termination, and the decision to issue one is final and non-negotiable.
14. Right to Pursue Collections
If a client fails to pay any amount owed to AstroGiagraphy, including but not limited to fees resulting from fraudulent chargebacks, missed session charges, or administrative fees, AstroGiagraphy reserves the right to refer the unpaid balance to a third-party collections agency and/or to pursue recovery through small claims court or other legal proceedings in the Commonwealth of Pennsylvania. The client shall be responsible for all costs associated with collection efforts, including agency fees, court filing fees, and any additional legal expenses incurred by AstroGiagraphy in the recovery process.
15. Public Reviews and Defamation
AstroGiagraphy respects the right of clients to share honest feedback about their experience. However, if a client posts a public review, social media post, or statement that is demonstrably false, misleading, or defamatory, AstroGiagraphy reserves the right to respond publicly with factual, non-confidential information about the transaction in order to correct the record. No private chart data, birth information, or confidential session content will be disclosed in any public response. AstroGiagraphy further reserves the right to pursue legal remedies for defamation, tortious interference, or any other actionable harm resulting from knowingly false public statements made by a client or former client.
16. Communication and Feedback Policy
All complaints, concerns, feedback, and service-related inquiries must be directed to AstroGiagraphy via email at Gianna@AstroGiagraphy.com. AstroGiagraphy commits to acknowledging all communications within five (5) business days and to making a good-faith effort to resolve any concerns in a timely and professional manner. Clients are expected to communicate respectfully and in good faith. AstroGiagraphy reserves the right to discontinue services to any client who engages in abusive, threatening, harassing, or defamatory communication.
17. Recording and Session Documentation
Clients may not record, screenshot, transcribe, or otherwise capture any live consultation, reading, or session conducted by AstroGiagraphy without express written consent from AstroGiagraphy prior to the session. Any unauthorized recording of a session constitutes a material breach of these terms and may result in immediate termination of services, forfeiture of any remaining sessions or credits, and legal action. AstroGiagraphy may, at its discretion, record sessions for internal quality assurance, training, or reference purposes. If a session is recorded by AstroGiagraphy, the client will be notified at the start of the session. Recorded material will not be shared publicly or with third parties without the client’s written consent.
18. Electronic Agreement and Acceptance
By completing a purchase, booking a consultation, subscribing to a membership, or accessing any paid or free content provided by AstroGiagraphy, you acknowledge that you have read, understood, and agreed to these terms in full. No physical signature is required. The act of purchasing, booking, subscribing, or engaging with services constitutes your binding acceptance of this agreement.
19. Confidentiality and Privacy
AstroGiagraphy takes client privacy seriously. Personal information, including birth data, chart details, and consultation content, will not be shared publicly or with third parties without express written consent. Anonymized testimonials, chart examples, or case studies may be used for educational purposes only with identifying details removed. Clients who wish to opt out of any anonymized use of their chart data may do so in writing at any time.
20. Intellectual Property and Liquidated Damages
All content, including but not limited to written reports, digital products, course materials, videos, social media posts, books, and educational curricula, is the intellectual property of AstroGiagraphy and is protected under applicable copyright law. No content may be reproduced, distributed, resold, or shared without express written permission from the owner.
Any unauthorized reproduction, distribution, resale, or public sharing of AstroGiagraphy’s proprietary content shall constitute a material breach of these terms. The client agrees that actual damages from intellectual property theft are difficult to quantify, and therefore agrees to pay liquidated damages of five hundred dollars ($500.00) per instance of unauthorized use, in addition to any actual damages, attorney’s fees, and legal costs incurred by AstroGiagraphy in enforcing its intellectual property rights. AstroGiagraphy reserves the right to pursue all available legal remedies, including injunctive relief, to prevent further unauthorized use.
21. Third-Party Platforms
AstroGiagraphy offers services and content across multiple platforms, including but not limited to Patreon, YouTube, TikTok, Substack, and Amazon. Purchases made through third-party platforms are also subject to those platforms’ individual terms of service and refund policies. AstroGiagraphy is not liable for platform-related issues including but not limited to technical errors, payment processing failures, or content delivery disruptions caused by the platform itself.
22. Testimonials and Client Feedback
AstroGiagraphy reserves the right to use anonymized client feedback and testimonials for promotional and educational purposes. No client’s full name, birth data, or identifiable chart details will be shared publicly without explicit written permission. If a client does not wish for their anonymized feedback to be used, they may notify AstroGiagraphy in writing.
23. Force Majeure
AstroGiagraphy shall not be held liable for any delay or failure to perform services due to circumstances beyond its reasonable control, including but not limited to illness, injury, natural disasters, pandemics, government actions, internet or technology failures, platform outages, power failures, or acts of God. In the event of such circumstances, AstroGiagraphy will make reasonable efforts to reschedule or deliver services as soon as practicable. Force majeure events do not entitle the client to a refund, though AstroGiagraphy may offer rescheduling or credit at its sole discretion.
24. Gift Purchases and Third-Party Bookings
If a client purchases a service, reading, report, or digital product on behalf of another individual (a “gift recipient”), the purchaser acknowledges and agrees to these terms on behalf of both themselves and the gift recipient. The gift recipient’s dissatisfaction with any service received does not entitle the original purchaser to a refund, chargeback, or any other form of compensation. AstroGiagraphy’s obligation is to deliver the purchased service in accordance with its standard professional practices, and the subjective experience of the gift recipient is not a measure of service quality or completion. The purchaser assumes full responsibility for informing the gift recipient of the nature of the service being provided.
25. Governing Language
These terms are drafted and executed in the English language. The English-language version of this agreement shall be the sole authoritative version for all purposes, including interpretation, enforcement, and dispute resolution. In the event that these terms are translated into any other language, whether by AstroGiagraphy, a third party, or an automated translation service, the English-language version shall prevail in the case of any inconsistency, ambiguity, or dispute arising from the translation.
26. Modification of Terms
AstroGiagraphy reserves the right to update, modify, or revise these terms at any time without prior notice. The most current version of these terms will be made available on the AstroGiagraphy website and will apply to all future transactions and engagements. Continued use of services after any modification constitutes acceptance of the updated terms.
27. Age Requirement
By engaging with any services or content provided by AstroGiagraphy, you confirm that you are at least 18 years of age. Services are not intended for minors, and AstroGiagraphy does not knowingly collect personal information from individuals under the age of 18.
28. Severability
If any provision of this agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
29. Entire Agreement
These terms constitute the entire agreement between the client and AstroGiagraphy with respect to the services provided and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written. No modification, amendment, or waiver of any provision of these terms shall be effective unless made in writing and signed by AstroGiagraphy. The failure of AstroGiagraphy to enforce any provision of these terms shall not constitute a waiver of its right to enforce that provision or any other provision in the future.
